2. Scope of application
This Privacy Policy applies to our website which can be accessed under the domain https:// bachmann.com/ (“Website"). It does not apply to the online offerings (ours or those of third-party providers) which are only referred to by a link on the website.
3. Personal data
Personal data are all information that refer to an identified or identifiable natural person. A natural person who can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier or one or more specific characteristics is deemed to be identifiable. These specific characteristics reflect the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. This includes information such as your first name and surname, your address and email address, your telephone number and your birthday.
4. Data processing and legal basis
It is possible to visit our website without providing personal data. We collect, process and use your personal data on our website as follows:
4.1 Data collected when you visit the website
The data specified in Point 5 are processed for technical reasons when you visit our website. This processing is based on our legitimate interest (Art. 6 (1) lit. f GDPR) in managing communication. We take the view that this is also in your interest as the website cannot be displayed in the absence of such communication. You can object to the processing of your data for this purpose at any time with future effect without providing reasons. However, please note that your personal data may still be processed when you visit the website after you have filed an objection, as it is not possible to stop the processing required for technical reasons for individual users of the website or in general. There are compelling legitimate grounds for processing which override your interests, rights and freedoms. 4.2 Data deletion and storage duration
Your personal data are deleted or blocked as soon as the purpose of storage ceases to exist. Please note that we may be required to store certain data for the duration of the statutory period on account of statutory storage periods. Data will also be blocked or deleted if a storage period stipulated by the aforementioned standards expires, unless it is necessary to continue storing the data in order to conclude or fulfil a contract.
4.3 Getting in touch by email
If you get in touch with us (e.g. by email), your personal data that your share with us in your email will be stored and processed by Bachmann GmbH. These data are only stored and used for the purpose of responding to your concerns or establishing contact and the associated technical administration. Your data are processed for the purpose of fulfilling a contract or precontractual measures (Art. 6 (1) lit. b GDPR) or we have a legitimate interest in processing, without any conflicting interests of yours prevailing in this respect, as the processing of these requests is in the interest of both parties (Art. 6 (1) lit. f GDPR). Once the request has been processed, we only delete your data or store them insofar as there are legal, statutory or contractual storage periods or further storage is required in order to assert, exercise or defend legal claims.
4.4 Ordering information material
If you request information material from us, we process your data either directly or via service providers commissioned by us in order to execute the action you request (e.g. shipment of our complete catalogue).
Your data will only be stored for as long as stipulated by the relevant statutory storage periods.
4.5 Registering for events
If you are interested in an event we are holding and register for it, we process your data either directly or via service providers commissioned by us for the purpose of organising, running and reviewing the event.
Registration involves a double opt-in process. Once you have entered your data, we will send you a personal verification code that you can use to register.
We may transfer your data to contributors (for participant/attendance management) or to our cooperation partners for the purpose of running the event. Your data will only be stored for as long as stipulated by the relevant statutory storage periods.
4.6 Data required for newsletter subscription
If you subscribe to our newsletter service, Bachmann GmbH will store and process your personal data (e.g. name, address, company and email address) for the purposes of sending the newsletter. Your data are processed on the basis of your consent (Art. 6 (1) lit. c GDPR) or for the purpose of fulfilling the contract (Art. 6 (1) lit. b GDPR). In this case, we will send you advertising information regarding the products, new items, events and campaigns for various product categories associated with our offering on a regular basis.
Dispatch service provider: We use Maileon to dispatch our newsletter and for all information services; the data provided in this context are not forwarded to third parties. MAILEON, a service provided by XQueue GmbH, Christian-Pleß-Straße 11-13, 63069 Offenbach am Main, Germany. Maileon uses cookies, which are text files that are stored on your computer and facilitate analysis of your use of the newsletter. The information generated by the cookie regarding your use of the newsletter (including your IP address) is read and sent to a server in Germany. The newsletters contain tracking pixels. A tracking pixel is a miniature graphic that enables us to ascertain whether a newsletter has been opened or not. This retrieval initially involves the collection of technical information, such as information on the browser and your system, the end device used and the mail client, as well as your IP address and the time of retrieval. This information is used to make technical improvements to the services using the technical data or the target groups and their reading patterns based on their retrieval locations (which can be determined with the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened, which links are clicked on and whether the emails have been successfully delivered. The reading duration is also recorded and this is only done on a target group basis. Although this information can be assigned to individual newsletter recipients for technical reasons, neither we nor XQueue attempt to monitor individual users. Rather, the evaluations help us to identify the reading patterns of our users and to adapt our content to them or to send out different content in line with their interests. We require explicit tracking consent before we can send you newsletters tailored to your preferences. If you have provided this consent, you have agreed to a personal user profile being created on the basis of your data so that websites and newsletters on products, services and market trends can be better adapted to your needs. This allows XQueue GmbH to provide you with information in line with your specific interests. Furthermore, you consent to the recording of your personal usage patterns on websites and in the handling of all emails from XQueue GmbH using cookies and tracking technology. You can revoke your consent to the creation of a personal usage profile at any time. You also have the option of revoking your consent by using the tracking cancellation link in each newsletter.
4.7 Data usage for advertising purposes
For our own advertising purposes, we reserve the right to store your first name and surname, postal address and, provided we have received this additional information from you within a contractual relationship, your job, sector or business name in combined lists and use them to send interesting offers and information about our products. The processing of your data for this purpose is based on the legitimate interest of Bachmann GmbH (Art. 6 (1) lit. f GDPR) in advertising products and services. We assume that you are generally interested in receiving such purely postal advertising. If not, you can object to the storage and use of your data for this purpose at any time with future effect without providing a reason by getting in touch using the contact address provided in Point 1. We delete your data for postal advertising without delay in the event of an objection, unless there is another legal basis for the processing or there are legal, statutory or contractual storage periods or continued storage is required in order to assert, exercise or defend legal claims.
5. Usage data
For technical reasons, whenever you visit our website, your IP address and other usage data (such as date and time of access, name of the page accessed, amount of data transferred and the requesting provider) may be collected and processed on our server. This is required to perform the communication process requested by you with our website.
Protocol data (server log files)
The provider of the website automatically collects and stores information in what are known as server log files that your browser transmits to us automatically. This includes:
IP address and, if applicable, host name of the requesting computer,
date and time of access,
name and URL of the accessed file,
website from which it is accessed (referrer URL),
browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
These data are not combined with other data sources, especially other personal data of the user. Temporary storage of the IP address in log files is required for technical reasons and to ensure system security, particularly for the detection of misuse. We also have a legitimate interest in processing data for these purposes pursuant to Art. 6 (1)1 lit. f GDPR. Unique identifiers are sometimes stored in the cookies so that your browser can be identified the next time you visit. The identifiers cannot be used to draw any direct conclusions about your identity. Detailed information on the cookies we use and similar technologies is available in our Cookie Policy (see Point 7).
We delete the data once they are no longer required to attain the purpose of their collection. The IP addresses of users are rendered anonymous.

6. Forwarding of personal data
In principle, we do not forward personal data to third parties, unless this is required to fulfil a contract (for example, transmission of address data to the shipping company for orders); this is otherwise permissible on the basis of relevant statutory provisions or if you have provided your consent.
6.1 We are sometimes supported by service providers in our business processes (e.g. to provide the website or other IT services or for maintenance), who may be exposed to your personal data. They process the personal data at our instruction and exclusively for our business purposes. The service providers are bound to us by processing agreements, which ensure that processing is carried out as instructed. The service providers only gain access to the personal data required to perform the relevant activity. These service providers are specifically prohibited from processing or using your personal data for any other purpose.
